Workers' Compensation

  • Pre-litigation advice, support and counseling for employers, carriers and third party administrators on various compensability issues.
  • Advice concerning general workers' compensation issues, including applicable defenses, causation issues and return to work issues.
  • Assist employers, carriers and third party administrators with pre-litigation Request for Assistance and filings with the Tennessee Department of Labor and Workforce Development, Workers' Compensation Division (TNDOL).
  • Trials in Chancery and Circuit Courts in Knox County, South of Knoxville to Chattanooga, to the West of Knoxville to Cookeville, and traveling Northeast, all counties between Knoxville and the Johnson City, Kingsport and Bristol areas.
  • Mediations/benefit review conferences before the TNDOL.
  • Appellate practice before the Tennessee Supreme Court and the Special Workers' Compensation Appeals Panel.
  • Coordination of Family and Medical Leave (FMLA) with workers' compensation absences.
  • Assist with reasonable accommodation obligations pursuant to the Americans With Disabilities Act (ADA) and returning employees to work.
  • Counseling employers to avoid successful pursuit of retaliatory discharge action when employees are not returned to work following an occupational injury.
  • Claim evaluation and valuation.
  • Preparation of petitions, final judgments, orders and Department of Labor Documents for settlement approvals before state courts and the TNDOL.
  • Counseling employers, carriers and third party administrators regarding compliance with the Tennessee Workers' Compensation Law, the regulations from the TNDOL, including claims handling standards, case management thresholds, § 204 Panels of Physicians, etc.
  • Counsel employers, carriers and third party administrators in the nuances of the Tennessee Drug Free Workplace Act.
  • Prepare certified drug free workplace programs for compliance with the Tennessee Drug Free Workplace Act.
  • Assist employers, carriers and third party administrators with fraud detection, prevention, and prosecution in conjunction with the Tennessee Bureau of Investigation.
